Artificial intelligence is now making its way into courts, law firms, and public services, profoundly transforming the way the justice system operates. What was once merely a tool to aid in document research is now becoming a central player in legal analysis, decision prediction, and administrative automation. This evolution is generating as much hope as concern.
The initial uses of AI in the justice system focused on case management: automated sorting, information extraction, summary generation, and accelerated legal research. These tools allow judges and lawyers to save valuable time, in a context where courts are often overloaded and processing times are excessively long. AI is becoming a discreet yet efficient assistant, capable of analyzing thousands of pages in seconds.
But the technology is now going even further. Some systems are capable of identifying recurring patterns in judicial decisions, estimating the chances of success of an appeal, or predicting the likely duration of proceedings. These models, used in several countries, promise a more consistent, transparent, and predictable justice system. Proponents see them as a way to reduce disparities between courts and improve equality before the law.
However, these advances raise major questions. The first concerns bias. An AI trained on past decisions risks reproducing—or even amplifying—existing inequalities. If the historical data contains discrimination, the algorithm will mechanically incorporate it. Several studies have already shown that some predictive models can penalize specific social groups, posing a major ethical and legal problem.
The second concern relates to transparency. How can we accept that a judicial decision is influenced by a model whose internal workings are opaque? Judges must be able to understand, explain, and challenge algorithmic recommendations. A justice system that relies on black boxes risks losing public trust.
The other issue concerns liability. If an AI makes a mistake, who is responsible? The judge who relies on it? The developer? The institution that deployed it? The law is still struggling to regulate these unprecedented situations. Experts are calling for strict regulation based on transparency, auditability, and mandatory human oversight.
Despite these risks, AI represents a real opportunity to modernize an often overwhelmed judicial system. It can accelerate procedures, reduce clerical errors, improve access to justice, and enhance administrative efficiency. But its integration must be gradual, controlled, and ethical. Justice cannot afford either opacity or blind automation.
The justice system of tomorrow will not be algorithmic. It will be augmented: a delicate balance between human rigor and the power of AI. A justice system where technology provides insight but never decides in place of humans. A justice system that modernizes without abandoning its fundamental principles.
The justice system is awash in purported AI solutions—for everything from prisons to courtrooms. But how do we separate AI’s real promise from the hype? And how do we ensure the technology helps, rather than sets back, the cause of fairness and justice?
Roy Austin, Jr., is the former Vice President of Civil Rights at the tech giant, Meta. He was also a prominent official in the Department of Justice under President Obama. He now heads up the Howard Law Artificial Intelligence Initiative.
“We have this fantasy that there is a neutral in this world and that’s what we are aiming for,” Austin says. “But there is no neutral.”
